The city is alleging that an outdoor hot tub installed by Lake Attitash Road resident Debra Dow sometime prior to December 2009 was built within 5 feet of her property line in violation of the city’s zoning bylaws.

In addition, the city has no record of a building permit for the project, violating another regulation.Dow served on the Municipal Council until 2001 and later served on the Board of Assessors as chairwoman. She left the assessors board in 2008.

After more than two years of correspondence, hearings and filings seeking the removal or relocation of the hot tub, the city has taken legal action against Dow in the form of a complaint filed at Lawrence Superior Court on May 3.
